Constitution & Rules of Flaxby Golf & Country Club
The Club will be known as Flaxby Golf & Country Club ("the Club").
The Club is a Proprietors, Club.
All matters pertaining to the use and enjoyment of the course and club facilities other than matters arising under Rules 1.-5 inclusive below, will be decided exclusively by the proprietors who will issue such rules and regulations as they may at their discretion decide from time to time.
The decision of the proprietors is final.
1. Conduct of The Game
- The Club agrees to recognise the R & A Rules Limited of St. Andrews as the ruling body of Amateur Golf and shall abide by the rules of Golf and Amateur Status as laid down from time to time by R & A Rules Limited.
- The Club agrees to comply with the Council of National Golf Unions Regulations and Rules of the SSS & Handicapping Scheme and any conditions imposed within the scheme by the English Golf Union and Yorkshire Union of Golf Clubs.
- The Club agrees to comply with the Constitution and Rules of the English Golf Union and of its County Union as laid down from time to time.
2. Subscriptions to the English Golf Union & County Union
The Club shall pay all subscriptions due to the Yorkshire Union of Golf Clubs and the English Union in respect of every male and female paying member of whatever category.
3. Disciplinary Powers
The Club shall duly exercise the disciplinary powers delegated to them under the English Golf Union Constitution.
4. Elections
The members of the club shall in general meeting elect not less than two of their number to form a Competition and Handicapping Committee or two separate Committees which shall have complete control of competition and handicapping matters within the Club provided such Committee(s) may a be appointed by a General Committee, the majority of whose members have been elected by the members in a general meeting.
5. Revocation
The rules 1 to 5 inclusive shall not be amended or revoked without the prior written consent of the Yorkshire Union of Golf Clubs and in the event of any conflict between them and the other Rules of the Club Rules 1 to 5 inclusive shall prevail.
6. Membership
- Each application for membership shall be make in writing on the form provided by the Proprietors. The Proprietors shall forthwith after the approval of the member give him/her notice thereof, and of the subscription payable. No member shall gain admission to the Club for any purpose until the subscription has been paid by the member.
- The payment of the appropriate entrance fee and subscription by any member shall signify the complete agreement to and acceptance of the Constitution and Rules of the Club by that member. The rights and privileges of every member shall be personal to him/herself and shall not be transferable by his/her own act or by operation of law and shall cease upon his/her death.
- The Proprietors shall have absolute discretion to decide whether any applicant shall become a member of the Club or not and shall have the right tot refuse any application for membership for any reason which shall deem good and sufficient without any explanation being given.
- A list of names and addresses of all members of the Club shall be kept by the Proprietors and the Operations Director on the premises. Members shall notify any change of address to the Proprietors and the Operations Director.
7. Members Guests
- Members may introduce one guest at any one time to the privileges of the Club ("Guest Privileges") on payment to the proprietors of a Guest Fee, the amount of which shall be fixed by the Proprietors from time to time and shall be displayed on the Club Notice Board.
- Guest Privileges shall apply both to weekday and weekends but the numbers of times members introduce guests shall be determined by the Proprietors. There shall be a visitor's book in which both member and guest shall sign. The introducing member shall be responsible for the adherence to the Club Rules and the general conduct of the guest.
- The following may not be admitted as guests.
- Former members who have been expelled
- Persons who have applied for membership but have been rejected
- Members who are under suspension
8. Classes of Membership
The categories of playing membership shall be designated from time to time by the proprietors and details will be displayed on the Club noticeboard.
9. Junior Membership
Junior Members shall be persons under the age of eighteen on the date they admitted into the membership of the Club. Junior members shall be entitled to use the Club and its facilities as stated in the membership pack and subject to the following restrictions.
- Junior Members under the age of fourteen may not enter the immediate bar area without adult supervision during the hours when intoxicating liquor can be sold.
- Junior Members aged fourteen and over may not enter the immediate bar area during the hours when intoxicating liquor can be sold unless accompanied by an adult member who accepts responsibility for such a junior member.
10. Entrance Fee & Subscriptions
The Proprietors shall prescribe the subscription from time to time. The current subscription rates shall be posted on the Club noticeboard.
Annual subscriptions shall be due for payment on the date stated on the application form. The Proprietors shall have the sole discretion to determine the amounts due.
11. Affiliations ot the Union
Affiliation fees to the unions shall be paid by the individual members when their subscription fees are due.
12. Resignations
Any member may resign his/her membership at any time by letter addressed to the Proprietors or Operations Director. The avoidance of any doubt any member resigning shall be liable for his/her subscriptions for the year during which the resignation takes effect.
13. Conduct
- If the Proprietors consider that any members conduct either inside or outside the Club may be prejudicial to the interests of the Club, or be injurious to its reputation the Proprietors may forthwith expel such member who shall thereafter be excluded from the Club without any further explanation being given.
- Without prejudice to the foregoing, no illegal gaming or betting shall be allowed in the Club under any circumstances and any member found by the Proprietors to be in breech of this rule shall be expelled forthwith.
- The Proprietors shall be under not obligation to repay to any member who has been expelled his/her subscription or entrance fee or any part thereof.
- The name of any member who is expelled shall forthwith be removed from the register of members.
- In no instance shall the conduct of any member of staff at the Club be made a matter of personal reprimand by any member. Any complaints about a member of staff shall be made in writing to the Proprietors or Operation Director who will take such action they in their absolute discretion deem necessary.
